A Kanye West fan on Monday sued the rapper and the streaming service Tidal claiming they duped users into subscriptions based on the promise of being the exclusive outlet for West's latest album.

The proposed class action lawsuit filed in U.S. District Court in San Francisco by Justin Baker-Rhett contends West fraudulently promised fans that his album, "The Life of Pablo," would only be available on Tidal. The site charges users at least $9.99 a month, but West's album has since been released for free on Apple Music and Spotify.

SUED FOR RIPPING 'NEW SLAVES'

Kanye West isn't the musical genius he thinks he is -- according to a composer who says the rapper jacked his song and didn't pay him enough ... so now he's suing.

Gabor Presser, a big shot Hungarian composer, says the last part of Kanye's "New Slaves" features one of his songs. Presser says right before the song was dropped in 2013, 'Ye reached out for permission to use it.

Gabor agreed, but says that was only under the assumption a formal deal would be laid out.



According to the docs -- obtained by TMZ -- Presser says Kanye sent him a $10k advance to push the deal through, but Presser says he never cashed the check.

It could end up costing Kanye way more. Presser's suing for at least $2.5 million.

Smells Like An Inside Job

Kanye West fell victim to a thief who made off with a bunch of gear from his creative studio ... and we're told the culprit could be someone 'Ye knows.

Law enforcement sources tell TMZ they got a call to Kanye's Calabasas office Tuesday for a burglary. We're told a door had been pried open overnight and the crook made off with a bunch of laptop and desktop computers totaling around $20k.

Our Kanye sources say they've already replaced the gear ... and no info was compromised thanks to some heavy-duty tech security.

Law enforcement sources tell us they don't yet have any suspects ... but we're told Kanye's team believes it was someone with direct knowledge of what was in the space.
